This Privacy Policy explains how Irish Owl, LLC, d/b/a mLOOP.co (“Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects Personal Information when you access or use our website, applications, and related services that connect any business entity or individual utilizing the Platform to post job opportunities and/or recruit prospective employees (“Employer”) and any individual utilizing the Platform to seek employment opportunities (“Candidate”) (the “Platform”). Our services are offered only in the United States and are intended for adults 18 and older. We do not sell Personal Information and we do not share Personal Information with third parties for their own marketing or advertising purposes. We use Personal Information to operate, secure, and improve the Platform and to provide the matching, messaging, and account features you request.

1. Effective Date and Updates to This Policy

This Policy is effective as of the Effective Date.  We may update it to reflect changes to the Platform, legal requirements, or our business practices.  When we make changes, we will post the revised Policy with an updated Effective Date.  If we make material changes, we will provide additional notice through the Platform or by email, where appropriate.  Your continued use of the Platform after the Effective Date of an updated Policy constitutes your acknowledgment of the changes.

 
2. Scope and Eligibility

This Policy applies to Personal Information collected through the Platform and through our customer support channels in connection with the Platform.  It does not apply to third-party websites or services that may link to or integrate with the Platform.

The Platform is offered only in the United States. You should not access or use the Platform outside the United States.  If you access the Platform from outside the United States, you do so on your own initiative and understanding that your information will be processed in the United States.

The Platform is intended for individuals 18 years of age or older.  We do not knowingly collect Personal Information from anyone under 18. If we learn that we have collected Personal Information from someone under 18, we will delete it and may deactivate the associated account. If you believe a minor has provided us information, please contact us at support@mloop.co.

The Platform connects Employers and Candidates. We operate a marketplace to facilitate introductions and are not an employer, recruiter of record, broker, staffing firm, or employment agency. We are not a party to employment agreements and do not guarantee outcomes.

 
3. Information We Collect

We collect Personal Information that identifies, relates to, describes, or could reasonably be linked to an individual.  The information we collect depends on how you use the Platform and the choices you make.

Account and profile information. We collect information you provide when you register or update an account, such as name, email address, phone number, location, and role (e.g., Employer or Candidate), and other profile fields you choose to include. Candidates may provide professional headlines, preferences, compensation ranges they choose to disclose, links to professional websites, and other profile details. Employers may provide business information, such as company names, business contact information, organization profiles, and job-related preferences.

Resume/CV and professional background.  Candidates may upload or enter resumes/CVs, work history, education, skills, certifications, licenses or license identifiers, and similar professional credentials.  You are responsible for ensuring this information is accurate and lawful to share.

Job postings and Employer content. Employers may provide job titles, descriptions, requirements, compensation ranges, locations, and other posting information, along with company information and branding.

Communications and content. We collect content you send or receive through the Platform, including messages between Candidates and Employers, introductions, scheduling communications, and support inquiries. We may review communications for moderation, security, troubleshooting, and compliance purposes as permitted by law.

Usage and device data. We automatically collect technical information about how you access and use the Platform, including IP address, device identifiers, browser and operating system, pages viewed, time spent, referring/exit pages, and interactions with Platform features. We use cookies and similar technologies for functionality, analytics, security, and to remember your settings.  See Cookies / Tracking / Analytics below.

Inferences. We may generate inferences drawn from the information we collect, such as matches or recommendations, or indicators of engagement with roles or candidates.

Optional sensitive fields.  We generally do not require sensitive Personal Information. If you choose to provide optional sensitive information—such as demographic information or government-issued identifiers for identity or license verification—we will use it only for the purposes disclosed at the time of collection or as otherwise permitted by law.  We do not request or want Social Security numbers, bank or routing numbers, full credit card numbers, consumer credit reports, or borrower/consumer mortgage application information on the Platform. Please do not submit such information.

Sources of information. We collect information directly from you (including business information from Employers and personal information from Candidates); automatically from your device and use of the Platform; from other users who interact with you on the Platform; from service providers that perform identity or license verification you choose to enable; from publicly available sources; and from third-party integrations you authorize. Where we receive information from a third party, we process it consistent with this Policy and any applicable contracts.

 
4. How We Use Information

We use Personal Information for the following purposes.

To provide and operate the Platform. We use information to create and manage accounts, host profiles, enable job postings, generate Candidate-Employer matches and recommendations, facilitate introductions and messaging, and provide requested features.

To communicate with you.  We send transactional and service-related communications, such as account notices, introductions, scheduling messages, and support responses.  Where permitted, we may send informational messages about Platform features.  You may manage preferences as described in User Choices and Rights.

To secure and maintain the Platform.  We use information for authentication, fraud prevention, abuse detection, incident response, and to enforce our Terms of Use and acceptable use policies.

To improve and develop the Platform.  We analyze usage to troubleshoot, measure performance, test features, and improve matching logic, user experience, and security.

For compliance and legal purposes.  We use information to comply with applicable laws, regulations, and legal processes, and to protect the rights, property, and safety of users, our Company, and others.

To create de-identified and aggregated data.  We may de-identify or aggregate Personal Information to generate insights that do not reasonably identify you, which we use for lawful business purposes, including analytics and service improvement.

We do not use Personal Information for third parties’ own marketing or advertising. We are not a consumer reporting agency and do not provide consumer reports under the Fair Credit Reporting Act; do not use information obtained through the Platform to make eligibility determinations under that law.

 
5. How We Share Information

We do not sell Personal Information. We also do not share Personal Information with third parties for their own marketing or advertising purposes, and we do not engage in cross-context behavioral advertising on behalf of third parties.

We disclose Personal Information only as described below.

With service providers and contractors. We share information with third parties that perform services on our behalf and under our instructions, such as hosting, security, analytics, communications facilitation, identity or license verification you elect to use, and customer support. These parties are contractually required to use Personal Information only to provide services to us.

With other users at your direction. By using the Platform, certain profile information may be visible to prospective matches depending on your role, settings, and actions. For example, Candidate profiles and materials are visible to Employers as part of introductions or matching workflows, and Employer profiles and job details are visible to Candidates. When you message, you share the content and any contact details you include with the recipient.

For legal and safety purposes. We may disclose information to comply with law, legal process, or governmental requests; to protect the rights, property, or safety of you, us, or others; to enforce our agreements; or to detect, prevent, or address fraud, security, or technical issues.

In connection with a business transfer. We may disclose or transfer information as part of a merger, acquisition, financing, reorganization, sale of assets, or similar transaction. The recipient will be required to treat your Personal Information consistent with this Policy.

With your consent or direction. We may disclose information to third parties when you direct us to do so or otherwise consent.

 
6. Cookies, Tracking, and Analytics

We use cookies and similar technologies to operate and secure the Platform, remember your preferences, and perform analytics. Cookies are small files placed on your device. Some cookies are essential to provide the Platform; others help us understand usage and improve performance.

Your browser may allow you to block or delete cookies. If you block essential cookies, some features may not work. You can also use device settings to limit certain tracking. Where we use analytics services, those providers may process limited information on our behalf to help us understand aggregate usage and performance.  We do not permit third parties to use analytics data collected on our behalf for their own advertising purposes.

Do Not Track and Global Privacy Control.  Most browsers offer a Do Not Track (DNT) setting; because there is no common industry standard, we do not respond to DNT signals. Some browsers support Global Privacy Control (GPC).  Where required by applicable law and relevant to sale/sharing or targeted advertising, we will treat a valid GPC signal as an opt-out request. Because we do not sell Personal Information or share it for cross-context behavioral advertising, such signals generally will not change how we process your information for the Platform’s core purposes.

 
7. Data Retention

We retain Personal Information for as long as reasonably necessary to provide the Platform, to meet the purposes described in this Policy, to comply with our legal obligations, to resolve disputes, and to enforce our agreements.  Retention periods may vary based on the type of data and how it is used.

When you deactivate or close your account, we will disable it and, within a reasonable period, remove your profile from active search and matching.  We typically retain account and Platform records for a limited period after closure for backup, audit, fraud prevention, fee collection, and legal compliance.  As a general example, we may retain core account records for up to 24 months after account closure before deletion or de-identification, unless a longer period is required or permitted by law.  Message content and job postings may be retained for a similar period for fraud prevention, compliance, and audit trail purposes.  Backup copies may persist for a limited time consistent with our disaster recovery practices.  If we are subject to a legal hold or have a legitimate need to preserve specific records, we will retain only what is necessary for that purpose and delete it when the hold or need ends.

You may request deletion of Personal Information as described in User Choices and Rights.  We may retain certain information as permitted by law, including for security, fraud prevention, and compliance.

 
8. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information.  Our safeguards include encryption in transit and at rest, role-based access controls, audit logging of administrative actions, vulnerability management and regular patching, secure software development practices, multi-factor authentication support where available, an incident response program, and hosting with reputable cloud infrastructure providers.  No system can be guaranteed to be 100% secure, and we cannot promise or warrant the security of any information you transmit or store with us. You are responsible for safeguarding your account credentials and using strong passwords and available security features.

 
9. User Choices and Rights

Access, correction, deletion, and export.  You may access and update certain account and profile details through your account settings. You may also request access to, correction of, or deletion of your Personal Information by contacting us at support@mloop.co. Where required by law, you may request a copy of your Personal Information in a portable format.

Communication preferences.  You may manage certain email and messaging preferences through your account settings or by following unsubscribe instructions in our emails. We may still send you transactional or service-related messages, such as account notices or messages necessary to provide the Platform.

Cookie controls. You can manage cookies through your browser settings. Please note that disabling cookies may affect Platform functionality.

Account closure. You may close your account through your settings or by contacting us at support@mloop.co.  Closing your account will disable your profile and limit further sharing.  We will retain and delete information as described in Data Retention.

State Privacy Disclosures Addendum.  Residents of certain U.S. states may have rights under state privacy laws, which can include the right to know, access, correct, delete, and obtain a portable copy of Personal Information, as well as the right to opt out of certain processing.  Because we do not sell Personal Information or share it with third parties for their own targeted advertising, opt-out rights related to sale/sharing or cross-context behavioral advertising typically do not apply to our current practices. You may submit a privacy request by emailing support@mloop.co.  We will verify your identity before fulfilling a request, which may require you to log in to your account or provide information we can match to our records.  You may use an authorized agent to submit a request where allowed by law, subject to verification of the agent’s authority and your identity. We will respond within the timeframes required by applicable law. If we deny your request, you may appeal by emailing support@mloop.co with “Appeal” in the subject line. Your rights vary by state, are subject to exceptions and limitations, and may not apply to certain business-to-business or employment-context information. We will not discriminate against you for exercising your rights.

 
10. Children’s and Minors’ Privacy

The Platform is intended for individuals 18 and older and is not directed to minors. We do not knowingly collect Personal Information from anyone under 18. If we learn we have collected such information, we will delete it and may deactivate the account. If you believe we have collected information from a minor, please contact us at support@mloop.co.

 
11. International Users

Our Platform is offered only in the United States, and we process Personal Information in the United States. If you access the Platform from outside the United States, you do so on your own initiative and understanding that U.S. laws may differ from those in your jurisdiction. We do not represent that the Platform is appropriate or available for use outside the United States and do not undertake to comply with non-U.S. data protection regimes such as the GDPR.

 
12. Third-Party Links and Services

The Platform may contain links to third-party websites or allow you to enable integrations with third-party services.  Your interactions with third-party sites and services are governed by their own terms and privacy policies, not this Policy.  We are not responsible for the content, privacy practices, or security of third parties. If you enable an integration, you instruct us to share data as necessary to provide it.

 
13. Additional Notices and Practices

Acceptable use and prohibited data.  To protect consumers and comply with law, do not upload borrower or consumer mortgage application data, bank or routing numbers, full credit card numbers, full Social Security numbers, credit reports, or similarly sensitive financial account information to the Platform.

Information in Candidate profiles, resumes, and related materials is shared with Employer users consistent with Platform workflows, and job postings and Employer details are shared with Candidate users. You control the information in your profile and what you include in messages and materials. Certain limited account information may be visible to our personnel and service providers to operate and support the Platform.

De-identified and aggregated information. We may de-identify or aggregate information so it cannot reasonably be linked to an individual and use or disclose that data for lawful purposes, including analytics, trend reporting, and service improvement.

Not a consumer reporting agency.  We are not a consumer reporting agency and do not provide consumer reports under the Fair Credit Reporting Act. Any background checks or verifications are provided by third parties under their terms. You must comply with applicable laws if you use such services.

 
14. Relationship to the Terms of Use

Your use of the Platform is governed by our Terms of Use available at mloop.co. The Terms of Use include important provisions regarding acceptable use, disclaimers, limitations of liability, and dispute resolution. If there is a conflict between this Policy and the Terms of Use on matters other than privacy, the Terms of Use control.
